Considering that the tanks were as good as identified as friendly forces, that no court-martial ever took place, or even a disciplinary hearing, and that one of the pilots involved is currently raining other pilots, let alone tha fact that the US DoD categorically denied the existance of the tape makes it absolutely criminal.
