Civ4 BTS City not flipping on civ spawn? (ethiopia)

So, i started a game as Egypt to see how much i could screw things up before switching to another civ. Because of capturing the pyramids i actually made my first historical goal, which entertained me, and my war chariots rampaged through Greece, Babylon, India and China before Ethiopia spawned, and I thought - what the hell, its not like anyone is going to actually found Christianity this game in a timely manner, Ethiopia's UHV might actually be possible.

Now, in the meantime, i had built an egyptian city right where Askum should be. So boy was i surprised when 10 turns later Abju (the egyptian name) still hasn't flipped to me. Heck, i thought spawning civs would demand their capitol upon spawn if it was owned by someone else. This is just really weird.

I can provide a screenshot if you like.

it's already fixed in the patch coming with BTS 3.13

I had something like this with Greece. I didn't want the TUrks to have their capital in my homeland(Sogut), so I founded a city right beside where it would be. Unfortuanatly, when the ottomans spawned, nothing flipped. All the others, Russia, Arabia, Babalyon, and Egypt declared war, and they died soon.

does the BtS patch include RFC update or we should download it ?
