Only had this happen once. Kamehameha did it on Immortal. Completely ruined a city for me, stealing multiple resources. There was never a war between us in that game, but if I wasn't busy fighting Hiawatha and Gustavus he would've paid.

I think you have to be more adaptable. You can't settle as many spots ASAP as you could in G&K. Sometimes you get lucky with early DoF(s) and you can go for 3 more cities before NC (2 produced, 1 bought settler), but most of my Tradition starts have seen me settle the most delicious location...
Usually not. Consulates is a no-brainer and you might want philantropy, but other than that there are better picks - mainly in Rationalism and your ideology.
If you have an average+ food start and build a Granary you should be able to get to five 5 pop in time for Collective Rule (Liberty Settler policy). It just make sense to get there before producing settlers with a Liberty start. That's my guess.
