Yeah I noticed this too. It totally ruined my Spanish conquest when they were able to hire elephants from the old world. :|
To make things worse it seems they can hire ANYTHING they want from the old world since it seems the merc window gives them swift access to africa and europe right when you first find them. This is kinda stupid... made worse since now hiring is cheap too, and the Aztec can afford hiring an army of elite troops. Shouldn't the americas be limited to american merc??

Don't you get pikeman with your army? If I can remeber, don't they chop up elephants and then eat them for breakfast?
it's fixed in next patch
