By a 5-4 vote the US Supreme Court rules in favor of the US Constitution.

I believe the long nightmare is nearing an end.

Justice Anthony Kennedy, writing for the court, said, "The laws and Constitution are designed to survive, and remain in force, in extraordinary times."

Decision found here (134-page .pdf).

Scalia said the nation is "at war with radical Islamists" and that the court's decision "will make the war harder on us. It will almost certainly cause more Americans to be killed."

An odd statement for an orginalist.

As much as it pains me to admit this... it is a living document.

See sig.

I thought that was understood as mostly a code-word for "tory hack" these days.

As Jackson said, "They made their decision, now let them enforce it."

Sorry to disappoint you 19th century fanboys, but tonight we're going to party like its 1789.

We're going to storm the Bastille!

At least some of the "originalists" and "strict constructionists" must be taking their own talk seriously, or this wouldn't have happened. Scalia, well ... I guess not.

I hope that if any President defied the Supreme Court today, regardless of party, he or she would be removed from office.

This is a step in the right direction, but we have to go through mountains of mold to reestablish what HC really was meant to be. It really hasn't officially existed since the Supreme Court ruled that the interment of the Japanese Americans was constitutional back in 1944.

I've never been able to understand how the "originalists" and "strict constructionists" could make the claim that they supported anything the Constitution said in the first place. :crazyeye:

Great news, I'm disappointed with Scalia though.

This entire country is messed up. Taxes for one are unconstitutional and should be changed way before we give terrorists rights.
