Can't build aqueduct?

I'm currently playing Emperor difficulty, I have construction and my cities can now build aqueducts. However, my 2nd city, New York, is unable to build it even though it it's a size six. One thing, though, is that due to my needing an entertainer it's not making any surplus food. Is this the reason?

I understand what's going on. Apparantly, you get a free aqueduct when you're on a river....
