I disagree.

Banning gambling will not stop gambling. The only effect that it will have on gambling is cause it to be more dangerous and risky than it is now. Also, it creates questions like: Are we really going to arrest these friends who get together every Friday night at one of their houses to bet a few dollars on poker?

People have the right to be stupid. People also have the right to be held accountable for their actions. If they do not have enough restraint to stop gambling before their lives are gone, then it is their fault. It is not the job of the law to keep people from being stupid; the law is meant for matters where the rights of others are being infringed upon.

Anyway, thats the great thing(or horrible thing) about money. You can influence decision making quite easily with it, and the more you make, the more you influence. Thats why, in my opinion, strict campaign finance limits are necessary .

But state and federal laws still apply to Indian owned casinos.
In the US Indian gaming is regulated by a federal statute that permits states to create gaming compacts with tribes. Tribes must act within the limits of the state gaming compacts. Those compacts spell out how much the state gets of the slot revenue. IN NM it is 9.5%. Those compacts also define what kinds of gaming can be offered in the casinos: class 2 or class 3.

Gaming aside, federally recognized tribes are not subject to state laws on tribal (reservation) land, but they are subject to federal laws. If a tribe owns land off the reservation, then whatever they do on that land is subject to the laws and ordinances of the jurisdiction in which it lies. Federal employment laws apply on tribal land. The biggest advantage to developing businesses on tribal land is that zoning laws don't apply. So if a tribe has reservation land in or near a large city, they can build whatever they want rergardless of the zoning next door. In NM Indian casinos are not allowed off tribal land.
 
I tend to think gambling needs to be regulated carefully. Gambling addiction is a very real problem and going OMG PERSONAL RESPONSIBILITY isn't good enough when you consider how much research goes into manipulating people's brain circuitry to maximise profit-taking.

In particular, the pokies (slot machines to you Americans) are pretty clear case of abusive, exploitative gambling.
