Justice Stevens to retire this summer

    Good for him for retiring before the Republicans takeover (or almost takeover) the Senate and raise a hellstorm for any Obama appointee. It shouldn't change the 5-4 Cons/Lib split unless Obama screws it up like Bush Sr. did for the Republicans.

    This has been speculated about for months. One can only hope that Obama and the Senate Dems have the stones to try and find someone as good.

    So that's 2 retirements, one more than Bush got (Rehnquist died)... I take it the justices didn't respect Bush much?

    Well, after Bush v. Gore, the four dissenting Justices weren't going to retire and allow Bush to name their successors. Now that a Democrat has won, Souter (who allegedly considered retirement on the drive home from the Bush v. Gore announcement) and Stevens retired.

    disclaimer: in no way is this post serious, and I actually hold Scalia in very high regard, though I think it is rather unfair he gets an extra vote (Thomas) for his decisions... actually that's not quite true, I ran across a case not long ago where they disagreed but I found that odd.

    He will be missed, but one has to think of the future also. He is going to be 90, and if he decided to serve until death, the possibility exists he could eke another 3 years and died under a Republican administration.

    This is a selfless decision by Stevens, and I commend him for it.

    I hope Kennedy follows Souter and Stevens' lead in quitting under a Democrat, but that very likely will not happen.

    Well, he votes conservative more often then not, so I doubt that he will retire under Obama. He'll probably try to retire under a Republican president.

    Of course its a wise decision on his part. It saddens me though, he's easily the greatest Justice on the Court we'll never be able to find someone as good as him.

    How is retiring as Supreme Court Justice so that the person who replaces you has a similar judicial interpretation to your own selfless? :confused: Besides, I'm sure he wanted to retire like everyone else would at that age.

    Considering that he will have served up to the age of 90, I think it is safe to assume that he actually likes being on the supreme court, otherwise he would have either never joined the court or perhaps might have retired earlier.

    I think Obama is going to stick with a white person this time, for bi-partisanship's sake :lol:. Apparently the front runners are Elena Kagan, Diane Wood, and Merrick Garland.

    I certainly hope so. Stevens was good, but he wasn't a William Brennan, Thurgood Marshall, or Earl Warren. And unfortunately, it looks like Obama won't be nominating anyone of their caliber.
