Man stops yobs robbing store, is arrested for assault

That is all well and good. In the meantime, until the new laws come into effect, does your Prime Minister or some other government official have the power of pardon if the guy somehow ends up getting sent to the slammer over this?

@Ziggy: I give a big thumbs up for multitude of reasons, Junk Yard Wars being up there. The UK rocks and I am sure this is just a bad blip.

No, I'm talking about these Guardian Angels. You don't know what's goin' down on the streets!

Well then, if you had further scrolled down in your own link, you would have seen this: ;)

United Kingdom
In London the Guardian Angels have been active since 1989, however, by 2007 they have become a very small group of around 12 and with very little activity. In Britain, the law requires citizens acting in self-defence to use "reasonable force", which leads to Guardian Angel training to centre on using the minimum possible force, and to only use force to prevent a dangerous situation from escalating. All violent crimes are reported to the police, and intervention leading to citizens' arrests (legal in Britain) or use of force is only employed in extreme cases.[5]

Their presence in London was highly controversial in the first decade of existence, press articles having likened their actions to vigilantism. In 1989, discussion in Parliament raised the possibility of American members of the Guardian Angels being deported owing to their presence being "not conducive to the public good" but this was rejected.[6]

It was self-defense. I don't even see how he needs to say it was a citizen's arrest, when the guy punched him in the face first.

It's highly likely that there is more to this case than the Daily Mail is presenting (given their track record for reporting...).

Also note that he's been charged, not convicted, so there's nothing yet to "overturn".

Holding someone down forcibly is depriving them of their freedom and is an arrest. It does not matter what was done to you, you still need to inform them that they're being arrested and what for otherwise it's an unlawful arrest.

Well, what do you know! It also reveals that citizens arrests are legal in England.

You don't know that what is presented in the article is all that happened.

I agree that, based on the defendent's accounts, he is innocent.........

But based on any defendent's accounts, he is innocent........

Daily mail certainly succeeds at presenting the most outstanding stories time and time again and i am wondering where in the world to they find them ?

There were witnesses.

Clearly ENGLAND NEEDS FIREARMS

When conducting a citizen's arrst in the UK, the detainee has to be told they are under citizen's arrest, otherwise the law will likely view it as illegal detention.

Yes. At the very least thier police do. Take baby steps first, then arm the populace.

Our armed police has shown that even they can't be trusted with firearms, don't think arming your regular bobby, especially not Commuity Support Offcers is going to lead in a reduction in crime, it's gonna end with a lot of very dead, very dark people.

Why won't anyone think of the children? They are most vulnerable. They need firearms first!

Indeed. I got my first gun when I was 11 or 12 (well, actual firearm. I got an air rifle long before that.) Armed children rock.

Charles Taylor approves this message.

Rock on!

I was shooting metal pebbles while you were wielding a real gun... :(

(I'm glad for that actually, becuase we once tried to play russian roulette with them (when I was 12) )

Or holding them down is the minimum force required to prevent them from hurting you further.

And that still does not explain why the poor bastard is being charged with Assault; A crippled man was defending himself against an attacker, and he ends up being charged with assault while the criminal is set free? What's wrong with this picture?

It's so much better to beat them unconscious when defending yourself, then. Got it.

I can see a lot of things that are wrong with this picture:
- we don't have all of it, only what the Daily Mail (bastion of the clear-thinking, level-headed, thoroughly-researched press) wants us to know
- it's not a representative picture (see Mise's links)
- we don't know how exactly he's crippled, but since he was able to subdue one of the dudes, I bet it's not too harsh.
