Man Sued for Protecting His Property

And so did he, they should have to go back to mexico, he should go to jail.

And what law did he break precisely that he deserves to go to jail for? Defending your property isn't a crime.

Their immigration status shouldn't have anything to do with this.

People come onto this guy's place, kill his livestock, break into the house, trash it, etc. He protects his property as he sees fit. He has plenty of reason to do it, since this seems to happen to him fairly often. He takes the trespassers to the proper authorities, as he should, when he is able.

The only thing he did wrong was kick the woman.

I googled. Am I looking at the right thing?
13-402. Justification; execution of public duty

A. Unless inconsistent with the other sections of this chapter defining justifiable use of physical force or deadly physical force or with some other superseding provision of law, conduct which would otherwise constitute an offense is justifiable when it is required or authorized by law.

B. The justification afforded by subsection A also applies if:

1. A reasonable person would believe such conduct is required or authorized by the judgment or direction of a competent court or tribunal or in the lawful execution of legal process, notwithstanding lack of jurisdiction of the court or defect in the legal process; or

2. A reasonable person would believe such conduct is required or authorized to assist a peace officer in the performance of such officer's duties, notwithstanding that the officer exceeded the officer's legal authority.

This is just like a case where a burglar sues the owner of a house because his porch was slippery so he injured himself while trying to steal something.

I think he should be allowed to put up a sign on his property that says:

"Tresspassers will be shot, survivors will be shot again."

I so want one. :please:

On a related note, the Arizona Penal Code is bull. "A reasonable person"? Jeez.

The problem along the border is more horrible than most of you realize. I spend a lot of free time along the border in the boondocks, and I've seen the results of this immigration issue. I've talked with ranchers who have fences cut, and thus lose cattle (at $500 a pop) as well as cases of butchered cattle in the field. This man has every right to defend his property and his source of income, and each one of you would ultimately do the same thing. In many cases these landowners inherited these ranches from their parents, and they spent childhood years improving the place. To see it ransacked must be awful. The most horrible thing is that some people find this landowner on the wrong side of morality.

Yes, but that is no excuse to the poor people who have the gun pointed at them.

Anybody who crosses an international border without checking in with the authorities should expect to have a gun pointed at them.

You must be thinking of some other place. This is Earth.

What's interesting is the people representing these sixteen people are probably financed by the Mexican government. The Mexican government has been trying to undermine this country for years. They give these people detailed instructions on how to get across the border, and most of them are involved in some kind of criminal organization. Ever hear of MS-13? One of the most wanted men in the world is a member of MS-13 and he is wanted becuase he took it upon himself to come to the United States, illegally, and do more of the same crap he did in Mexico. Don't mention what the smugglers and criminals do to the border agents trying to help protect their country. Try explaining the plight of the "poor illegal immigrants" to the widow of the man that had his head lopped off from a piano wire strung across his route. Mexico is still pissed about the Mexican-American war and they feel that they should have Texas, New Mexico, Arizona, Nevada, and California back under their control. That is why they direct the Mexican Consulate in California to hand out text books saying this to the schools. This article makes me believe even more that we should have Abrams tanks and Bradleys patrolling back and forth across the border instead of ATVs and up-armored F-150s, and the ROE should be changed to match the sign that I saw earlier on this thread.

You, good sir, are an idiot.

Otherwise, the man is justified in his defense of his property. The dog and the kick were unnecessary.

OMG HOW DID YOU FIND OUT THE TRUTH?!?!?!111111

Yeah, this.
Based on the information given in the article, the man clearly didn't do anything wrong besides kicking the women - which sounds exactly like being invented to show what a terrible person he really is. Still I see no problem that he was brought to court. He'll likely be acquitted.

However, I must also point out that if this one man has been able to catch even 1/1oth of the immigrants he claims, then the US Border Patrols suck. Big time.

The guy is a hero. He should really be collecting money from the state for doing its job for them.

Pretty outrageous. There is a lot of gray area in this story and it is told pretty exclusively from Barnett's side. However, as long as the guy didn't use unnecessary cruelty when dealing with the immigrants, I do side with him. It must be extremely annoying and dangerous to have strangers trespass and destroy your property. Who knows when one of them will decide to enter his house and kill his family one day? I'm not saying illegal immigrants are violent criminals, but of the thousands that trek through his property, at least a couple of them must be crazy enough to do something violent. The fear and paranoia will keep me awake at night.

I commend this guy but I cannot demonize the Mexicans. When they step onto U.S. soil, they are trespassing. There's no way for them to get anywhere without breaking the law.
