it's still possible to track you, since they can get to the proxy, and through it the can find out your real IP. Proxies don't block your ip adress, they just act as an intermediary between you and the other party.
Furthermore most (if not all) p2p-software don't use proxies. It would be extremely impractical since all traffic would have to go through the proxy, which would mean huge loads....

oh, and if it is a crime, isn't allowing people to download it even the bigger crime? :mischief: (after all people who seed are usually punished harsher than those who leech....)
 
When police set up trapped cars for theives. The theives are punished even though they didn't really "steal a car." Same with the downloaders.

That's entrapment by the police. The perpetrator is not criminally liable.
 
The program would be disguised as an illegal song. So if someone download it, it's reasonable to believe that the are trying to download the song not the program.

It would be entrapment if the police disguised the program in a file that says "Red Stranger riding his bike," because that is a legally downloadable file.

I have no worries then, since this is definitly illegal in sweden (since it encourages crime). Dl on!

you cannot punish somebody for something he hasn't done. If somebody downloads a picture called "my8yodaughternude.jpg" that shows red stranger riding his bike, he wouldn't be guilty of consuming child porn, would he?

the filename says exactly nothing about the contents of the file. likewise would it be allowed to download a song called "KaeptnOviscopyrightfreesong.mp3" that really contains "under jolly roger" by Running Wild? I think not....

and even if that action by the police was legal, it wouldn't really be a problem. just some change the filenames and tehy wouldn't be able to get you, after all i just downloaded suse10.iso not some musicalbum :mischief
 
And what if the files are encrypted? What constitutes "music"?
