New Fanatica Constitution


Article 1: The Legislature

Section 1
Everyone who signed up in both the Parliamentary sign up thread and the city registry per CIVILITAS Constitution 1., 1A. and 1B. are entitled to vote and be elected in the New Fanatica Assembly.

Section 2

All legislative powers herein granted shall be vested in the Assembly of New Fanatica.

Section 3
The Assembly shall have power to lay and collect fees, taxes and duties, to pay the debts and provide for the Provincial projects and general welfare of Civilitas and to help contribute to the common defense of New Fanatica and Civiltas.
To borrow money on the credit of New Fanatica;
To constitute tribunals inferior to the New Fanatica Supreme Court;
To establish a capital;

Article 2: The Executive

Section 1
The head of the executive branch is the Governor(G) , who will be elected by the members of the Assembly.
Nominations start on the 10th day before the end of the month. A G will be elected on 7th day before the end of each month. Voting will last for 2 days.
The candidate who receives more than 50% of the vote wins. If no candidate receives more than 50% of the vote a special run-off election will occur between the two candidates with the most votes lasting 2 days. If there is a tie for second place in the election the runoff will occur between the first place candidate and all candidates in second place.
If there is a tie for first in the runoff or if none of the candidates receive a majority a third election 2 day election will be held whoever receives the most votes shall be G
If there is a tie in the third election, the current G decides the next successor
The new G takes office the stroke of midnight UTC on the new month

Section 2
To be a candidate for G you must announce your candidacy in the appropriate thread.
A GM will run the election.

Section 3
If the G is removed there must be a new election within 2 days of his removal to select a new G.

Section 4
The G has the power to appoint members of the New Fanatica Supreme court when there are vacancies with the approval of the Assembly.[Simple majority of voting MAs]

Section 5
The G can appoint various Ministers with the approval of the Parliament.[Simple majority of voting MPs]
The ministerial positions are created by laws passed by the Assembly and signed by the G.
The Governor can also appoint a named successor with the approval of the majority of parliament. A named successor can also hold ministerial positions. If the G is absent the named successor will fill in for him. If the G was removed by a vote of no confidence the named successor will take over until a new G is elected.

Section 6
The Governor has the power to fire ministers but not New Fanatica Supreme Court judges.

Section 7
The Governor retains his seat in the Assembly.

Section 8
The Governor can be removed in a no confidence vote.[2/3 supermajority of voting MAs needed to remove.] If the vote is successful a new G must be elected. After the vote succeeds, there will be 2 days for nominations. Then voting will occur for 2 days. If no candidate receives 50% of the vote there will be a run-off election for days. If the new G is elected with more than 2 weeks left in the term, he will have to stand for reelection at the end of the term. If there are less than 2 weeks left in the term then the new PM will finish the term and serve for the next term as well.

Section 9
Ministers can be removed in a no confidence vote.[simple majority of voting MAs needed to remove.]

Section 10
The G will be commander of the provincial home guard.[The Assembly will determine the the size and scope of the provincial home guard through laws]

Article 3: The Judiciary

Section 1
The Judiciary consists of the New Fanatica Supreme Court (NFSP), which is a panel of three judges.

Section 2
3 MAs appointed by the G and approved by the Assembly will serve as judges on the Provincial Court. The 1st Judge appointed will serve one month, the 2nd for 2 months, and the 3rd for 3 months. All subsequent judges will serve terms of 3 months.
The first Provincial Court will take office 2 weeks after the G is elected.

Section 3
A nominated NFSP Judge may serve while waiting for confirmation. If a nominated Judge is not approved, he may no longer serve and the G must nominate someone else for the position of NFSC Judge.

Section 4
Decisions within the Provincial Court are made by a majority of the three judges. Unanimity is not required.

Section 5
If an MA believes that a law is unconstitutional, or another MA has violated the law of Civilitas or the constitution , he may take his case to the New Fantica Supreme Court. The MA who brought the matter before the Court must prosecute the case [or select a lawyer to take their place]. If the case brought before the court is about an unconstitutional law, the MA who proposed the law must argue for the defense[or select a lawyer to take their place]. In the case of an absence the PC may appoint someone to the defense. If the case is that an MA violated the law of New Fanatica, the accused must defend himself [or select a lawyer to take their place]. The accused cannot be tried in absentia.

Section 6
Provincial Court judges may be impeached for misconduct in office.
A majority of 3/4 of voting members is required to impeach NFSC judges.

Section 7
Judges retain their seat in the Assembly.

Article 4: The Metropolitan Areas

Section 1
New Fanatica consists of Metropolitan Areas.

Section 2
The inhabitants of each Metropolitan Area shall create a constitution, laws, rules, and regulations for themselves, until they create their own constitution they will follow the New Fanatica constitution as their constitution for their Metropolitan Area.

Section 3
New Fanatica Laws [Including the New Fanatica Constitution] supersede all Metropolitan laws and Constitutions.



Article 5: Voting

Section 1
A number of bills can be discussed in Assembly, the exact specifications can be found in the following sections.

Section 2
For a law to pass it must have a majority in the Assembly[Simple majority of voting MAs] and be signed by the MA.

Section 3
MAs have the right to bring forward a bill if they have the endorsement of at least 4 MAs, including them self. The names of the MAs must be noted in the bill.

The Governor has the right to bring forward up to 2 bills per month, plus appropriations and taxation bills.
[Appointments do not count.] .

Ministers can bring forward one bill per month relating to their position.

Section 4
For every bill a thread has to be opened.
The person that brought the bill forward must open and maintain the thread.

Section 5
The person that brought the bill forward has to present the bill in a clear form, following standard Assembly rules.

Section 6
Debate shall be subject to standard Assembly rules, and standard motions may be suggested.

Section 7
Motions shall be debated in the thread. The person that brought the bill forward may amend a bill if 3 people who have participated in the thread AND approve the amendment. An MA may withdraw his endorsement if they do not like the bill because of any changes. The bill may not be brought to a vote until another person endorses the bill.

Section 8
After at least three days of discussion, the person that brought the bill forward can decide to bring the bill to a vote. If a bill is not brought to vote after 2 weeks debate will end and the bill can no longer be brought to a vote.


Section 9
Voting is allowed for every MA.
Voting shall take place for two days.

Section 10
The options shall be "Yes","No", and "Abstain". If a simple majority vote yes on the bill it goes to the G.
The PM can sign the bill which then becomes law, or veto it.
Ties result in the rejection of the bill.

Section 11
The one who opened the thread does the vote count. He also announces the official result, which can be challenged at the Supreme Court. In that case the court decides about the validity of the challenge and may eventually perform a recount itself and override the official result.

Section 12
Appropriation and Taxation Bills, unless endorsed by the Governor , must gain 5 endorsements. The G once during his/her term must introduce an appropriations and taxation bill into Assembly. Failure to do so will require the Parliament to take a vote of no confidence. If the Governors budget and taxation bill does not pass Assembly, the previous budget and taxes remain in effect. However, otherwise they follow all conventional rules.

Section 13
Anytime the Assembly votes on appointments the standard rules apply.

Article 6: Special Bills

Section 1
These include, but are not limited to: ratification of treaties, constitutional amendments, changes to provincial symbols, policy ratification, votes of no confidence and Impeachment of NFSC judges.

Section 2
A Constitutional Amendment amends this Constitution and must be ratified by a 2/3s majority in the New Fanatica Assembly.

Section 4
All other special bills must have a simple majority.


Article 7 Misc
Section 1. When counting votes only MAs that voted count.

Section 2. If a person is inactive for 1 week they will be removed from their ministry/NFSC seat/Governorship. However, if a person knows that they will be absent in advance they may appoint someone to take his or her place until he or she returns or the term ends.

Section 3. No Member of Assembly may hold more than one G, ministerial, or NFSC position.


Article 8
For this constitution to become the law of New Fanatica 2/3 of the people of New Fanatica must approve of it. The vote will last 3 days.

According to our Constitution, this requires at least three days of discussion prior to being put to a vote. Therefore it is my understanding that this poll is invalid. Unless of course I missed the prior discussion. Though I believe this falls under the "Special Bill" clause, I see no reason why it should not still follow through with the Constitution as quoted below.

You are right Methos, this should have a discussion thread.
 
This is not a federal bill there for it does not fall under the federal constitution.

This falls under NF organizing its government.
