If Rialmo can show that LeGrier was at least 51% responsible for Rialmo's actions than the LeGrier estate cannot collect anything from Rialmo. This can also help Rialmo to defend against any subsequent action by the Jones estate.

The LeGrier estate already can't collect anything from Rialmo, and neither can the Jones estate, so no defensive action is necessary. You can sue the department, but individual officers are not subject to suit for their actions.

Individual officers are liable to be sued. You can sue the department or the individual officer or both. However if the criminal/internal investigation determine its was clean shoot then a civil suit has very little chance.

In this circumstance if it is determined to be a clean shoot then I would say the officer's case against the individuals estate is warranted and might set a good example to stop future unwarranted protests and civil actions against departments and officers when it is determined no wrong doing has occurred.
