Hawaiian accused of Obama death threat

Federal agents have arrested a Hawaii man after he allegedly threatened to kill President-elect Barack Obama when he visits Hawaii on vacation this month.

Mark Miyashiro allegedly made the threats on December 3 to a doctor who is treating him for a schizophrenic disorder, according to a criminal complaint filed in the US District Court.

Miyashiro then allegedly made more threats when Secret Services agents interviewed and arrested him at his home in Kaneohe the next day after the doctor notified authorities. They also confiscated a Russian SKS assault rifle.

Miyashiro is charged with one count of threatening the life of the president or the president-elect, which is punishable by up to five years in federal prison, a $US250,000 ($A381,000) fine and up to three years probation.

He is being held at the Federal Detention Centre in Honolulu.
What do people think of this? I understand that they need to be both thorough and careful where the life of the president/president-elect is concerned, but it sounds more like this guy needs medical assistance than a gaol term. Of course, it does say a skizophrenic disorder, not skizophrenia itself, but I assume that means a something very close to skizophrenia, in the same way Aspergers' is an autistic disorder.

Besides that and on topic, it depends on whether or not the man is able to form intent in his mind. If he really has a schizophrenic disorder, then the count will be easily stricken. However, if he is capable of forming intent to commit a crime, then he should be punished.

In other words, I believe he should be tested by the legal system to determine whether or not he is guilty.

It's weird how you can threaten to kill non-presidents all the time & no one cares but God forbid you say, that's it, I'm gonna kill the mother------ in regards to a world leader, then you're in felonious trouble.

You're right of course. I threatened to kill three people just today, and that doesn't include my desire to painfully sodomise Baz Luhrman before murdering him that I expressed on this board.

Threatening to kill anyone is a felony. They take this more seriously, because the President(-elect) is a bit more important than your average Joe.

The guy needs to be put into a psychiatric hospital. Threatening anyone is the sign that a doctor needs to put some patient into a hospital.
 
Yeah, just because the arrested him and charged him doesn't mean he will go to jail. At the court proceedings his competancy will be evaluated and he very well may get a sentance to a criminal psychiatric hospital (which just means it is more secure than a normal one).
 
The Secret Service (SS?! :shifty:) interviewed the guy before he was arrested. Let's review the course of events:

1. Guy threatens Obama during psychiatric care.
2. SS interviews him.
3. He threatens Obama again, during the interview with SS!
4. They discover he has a sniper rifle.

I'm pretty sure that guy needs to be in custody. He can go to a hospital instead of jail, I suppose... but arresting him was not optional.

Could you imagine the SS are like "well, he even threatened Obama to us and he's got a sniper rifle, but... meh, let's just go... he probably wont do anything. Ok, later dude!"

C'MON

WTH do you expect them to do??

What do you think, Narz? If I told my shrink that I was gonna kill you and the cops came to talk to me and I said "hell yea, Ima kill that bastard with this sniper rifle right here!" Would you be happy if they were like "Ok, later dude!"?? Do you think that just maybe your family would have a legit complaint if I then poped your skull?

I don't know. I just image googled the darn thing, and this was the first hit. I was one of the people who never saw a Russian SKS assault rifle.
