    Roosevelt tried packing in his first term. As it worked out, he just outlived them.

    Given the way the election is unfolding, the most likely outcome is that Trump nominates the replacement before the election and it is confirmed in the new session. Trump losing is unlikely and Republicans losing the Senate is very unlikely.

    While there is talk of stealing the seat, that bridge was burned in the Kavanaugh hearings. Likewise threats of mob violence. If needs be, full speed ahead.

    I agree with you that this is the most likely strategy they'll use. I read McConnell has already pledged that Trump's nominee will get a vote in the Senate but I didn't see that he had said when.

    He can start the nomination process and maybe even have hearings but delay the actual vote until the lame duck session. I would expect Collins and Gardner to give us all a parting gift on their way out by voting to confirm whoever is nominated.

    It really says something when all the adherents of an ideology are happy at the chance to impose minority rule through rigged elections while they're busy getting hundreds of thousands of their own people killed through their cult leader's ego. Such an ideology is morally irredeemably evil.

    Mitch has the best of both worlds. He can instruct three senators in difficult situations to vote no to protect themselves, while guaranteeing 50+ pence. Or he can wait until after election. If trump wins, they can vote then with no consequence. If trump and the senate are already lost, why not just send one last destructive gesture in and totally muck up the Dems during the lame duck session. That's been the Republican policy at the state level now in multiple states, when they lame duck strip the incoming Dem governor.

    You realize that youre in that minority and in that cult, right?

    There is no way they try to push this through before the election. While there will be plans for doing it in the lame duck session, but only plans. Trump can make his announcement and that will be it unless the sky falls.

    But collins is "very concerned!!!!" as the supreme court rules 5-4 that the hand count of Pennsylvania mail in ballots are unconstitutional, and the SoS must certify the state's electotal vote winner as trump.

    I actually think that Trump will nominate a woman because of all the presumptive goodwill it will generate. It will give the Republicans a claim of moral high ground and place the Democrats in the uncomfortable position of having to oppose a woman for SCOTUS.

    Also, Reagan appointed a woman, Justice Sandra Day O'Connor... so I'm sure Trump would relish the opportunity to point out that similarity.

    I agree with @onejayhawk and @schlaufuchs that there is no reason to ram a nominee through before the election when they can just ram one through in the lame duck session. Plus its a fantastic wedge issue for the Republicans to drive voters to the polls.

    There is no way those Republicans make any statements like those. To the Senator Gardner's of the world the critical thing is to NOT make any statement or take a position, and above ALL not to vote. He has to let normal people in Colorado believe that he is not one of those Republicans because he needs every vote he can get, but he also cannot afford to alienate the Trumpists in Colorado for the same reason.

    You have predicted the most likely outcome though...they will ram it home in the lame duck session as a last 'get screwed' to America.
