The Craig James Law--apparently you can shoot a hooker in Texas

A jury in Bexar County, Texas, just acquitted Ezezkiel Gilbert of all charges he received for murdering a 23-year-old escort he met on Craigslist.

The jury felt that because the escort refused to have sex with him after he had already paid her fee of $150, it was perfectly okay for him to shoot her to death.

Gilbert admitted to shooting Lenora Ivie Frago in the neck on Christmas Eve 2009 when she accepted his money and then tried to leave his home without fulfilling her duties. Frago was paralyzed by the shooting and died several months later.

The shooter’s defense claimed that the gunshot wasn’t intended to kill Frago and because she was attempting to steal from Gilbert, she violated the Texas law which permits people “to use deadly force to recover property during a nighttime theft.”

If the 30-year-old was convicted, he would have faced life in prison. Why Frago refused to have sex with him remains unknown.

So what do we think of this? Doesn't this basically make it legal to say, shoot a guy who stole your drugs? Could this theoretically be a legal problem if prostitution was legalized? Do you think this is just? Is this how Craig James got away with killing five hookers while at SMU?
 
Would you have worded this differently if he'd shot someone trying to steal his car?
 
The original law seems a bit dangerous, but given that it exists the particular application appears correct. If she didn't want to fulfill her side of the deal she should have returned his money.

This seems unreal. Are we sure this is from a trustworthy source.

Guess that's one of the things they teach you in criminal procedure.

That's why Americans are so freaked out about that girl being re-tried in Italy. It is so ingrained into us that such a thing is a gross violation of a person's rights.

Yeah the law is pretty out there, but I don't see what's particularly extreme about this particular application? As opposed to any other application of this law?
 
I've got some deadbeat clients that need to be lined up against the wall.

But remember to shoot them only after sunset. (with a shotgun, in the face, while drunk)

How can there be a breach of contract when prostitution is illegal ? I guess he couldn't have taken her to court without incriminating himself.
Doesn't justify him shoting her over 150$ in the slightest. At the very least, this should have been manslaughter.
