Trump Seeks Recusal Of Trial Judge
Donald Trump is seeking the recusal of the judge presiding over his criminal case in Manhattan, arguing he has conflicts of interest and can’t fairly oversee the trial. State Supreme Court Justice Juan Merchan should recuse himself because his daughter, who works for Authentic, a digital agency with Democratic clients, could financially benefit from a conviction of Trump or decisions the judge makes in the case, lawyers for Trump argued in a filing made public Friday. Trump’s lawyers also argued that Merchan induced Allen Weisselberg, the Trump Organization’s former finance chief, to plead guilty to tax-fraud offenses and testify against the former president’s business interests at trial. A jury convicted the company last year.
Manhattan District Attorney Alvin Bragg in April unveiled an indictment charging Trump with falsifying business records for his role in a hush-money payment to a porn star on the eve of the 2016 election. Trump has pleaded not guilty and said he did nothing wrong. He has accused Bragg of being motivated by politics in bringing the case. Merchan, who previously declined a request to recuse himself from presiding over the earlier Trump Organization tax-fraud trial, will make his own decision on the former president’s recusal request. If he denies it, the Trump lawyers could ask an intermediate appeals court for permission to appeal.
A spokesman for the state court system declined to comment on behalf of Merchan. A spokeswoman for Bragg said the office would respond in court papers. Authentic and a lawyer for Weisselberg didn’t respond to requests to comment.
