what can't i declare war

against a certain civ. The peace treaty ran out long long time ago, but the "Declare War" button is greyed out and says can't declare war until current peace treaty runs out. Bug? or am i just stupid?

This hasn't been patched yet, but it likely will be as soon as they release the next patch.

Well, I don't think it's been patched but when it is, steam should do it for you. You don't have to go to their website.

Anyone know what causes this so I can avoid it? Really killed a game that I was quite far into.

Don't think it's known. If you notice early, load an autosave. I try to keep an eye on peace treaties expiring to make sure it triggers correctly so it won't screw up my game.
