It has been some time since anyone has been here. But in Term 5 there is finally another Justice of the Court. Don't hesitate to approach the Court with questions, suggestion or any other type of approach.

For your (and my) convenience I hotlinked the Constitution

I hereby officially declare the fifth term Court opened :hammer:
 
Justice Gert-Janl, I have raised questions before about our constitution, but was rudely ignored by past JoTC.

Article O
Treaties and agreements with foreign nations may be ratified by
Fanatica with a poll open for minimum 48 hours. A simple
majority of voters is required to ratify the treaty or agreement.
§1. In matters of extremely urgent national security (ex. impending
invasion), the Administrative Council may chose to sign the treaty,
making it binding for all of Fanatikou. However, the Chief Jutice
would have to verify that is was indeed a matter of extremely
urgent national security.

Does that mean the ENTIRE councle (MoIA, MoMA, MoFA) have to agree to something to have an emergency plan done. By that time 48 hours would have passed. I think that it should be the MoTA, with confermation from the MoFA or the ambassidor to that nation.

I thought the ambassidor position would have no affect on policy decisions? I remember quite clearly being told that the ambassidor only represents the will of the people as dictated by the MoIA. Does this mean when we meet another civ that yet another ambassidor could also interpret policy in "emergency" situations?

I mean that I do not want the MoIA making a decison all by him self. I said MoFA or the ambassidor, since if it really is an emergency, and the MoFA is not around, the ambassidor should be second choise.
 
I thank Emp for raising this point.

The constitution currently demands the entire Administrative Counsil (i.e. MoIa, MoFa, MoD) to agree to the signing of an emergency agreement. There's no doubt here, the Constitution is really clear.

So far for interpreting the Constitution. The following is not part of my 'ruling', and is definitely not binding, but only my opinion as a citizen

I agree with Emp that this is not a time-effective measure, and that it might be a good idea to allow the MoIa in a really urgent national security situation to act without the input of his entire Administrative Counsil.
...hmmm...I smell the air of the first constitutional amendment here...
 
As far the the current CoIA is concerned, I can hold the save open for a couple of hours. Actually, the rules permit us to open the save, quit the turn without moving anything, then open it again but this might count as a reloading. With open save I can then contact the CoMA, CoFA, and JoTC provided if I have their MSN, ICQ, irc, YIM, or other means of contact. Making it through the tread would take forever indeed, probably over 24 hours. And I might be unable to run C3C with a loaded game for that long time.

But I don't know what other options are there...

I want to first say that I am deeply sadened and distraught that it has come to this. I never wanted this to happen, but the fact it has happened underlines how serious of a problem we are facing. We have a select few in this nation who seek to arbitrarily impose rules and regulations upon us. People who ammend the constitution without the consent of the assembly which serves this country! This case is not about the ammendements themselves. It is about due process and respect for the constitution and the citizens of Fanatica! Therefore, I ask the court not to judge the ammendements that have unilateraly been imposed upon us, but I ask the court to consider the way in which the constitution was grotesquely violated. I asked the accused on multiple occaisons to follow due process, but he would not.

I am filing a complaint against the citizen Rik Melet.

He is in violation of Article K and Article A of the constitution of the Nation of Fanatica.

Evidence
There, the accussed threatens the cancellation of our citizenship if we do not provide him with an email address and if we do not post in that thread.

That violates article A, which says that all one must do to become a citizen is :
" register in the Citizen Registry are[to become] citizens of Fanatica." Nowhere in the constitution of this great land does it say that one must re-post in a thread and provide the forum admins with a valid email address.

The violation of Article K also appears within the same thread. Article K states : "A majority of the active Assembly shall be required to amend the Constitution." Rik didn't even poll the Assembly! Blatant disrespect towards the assemblymen and woman of this country!

For this crime against the constitution, I seek a simple reversal of all the threats to the citizenry made by the accussed.

It would appear you are correct Goonie but theres nothing in the constitution that prevents Akots from nominating any citizen.

On the other hand I support an amendment banning citizens who have nothing better to do than spout legalese and spam forums in what used to be a fairly fun demogame. *Sigh* The pre goonie and provo days were so much more fun.
 
Since we are talking urgent matters of war and peace and Matrix will not certainly object to this temporary appointment and is sleeping apparently, I don't clearly see how the authority of CoFA has been overstepped by me.
 
Akots actually got a point, but to make it formal enough for all purposes of the Demogame, just let Matrix add a post here nominating Rik, and that would be an end to it. This issue is pretty small indeed.
 
I have no problem with Rik whatsoever! He would be great for the position as he already knows many of the members at CDZ.

What irked me was that I tried to raise a valid point in the nomination thread about how the appointement should work, and akots jumped on me for wanting to follow the rules that were set up for a reason. He completely disrespected me and the system.

Magnus - I guess there is some history here you do not understand. Once all the rules are followed by everyone, I assure you the game will be fun. The rules were put in place so that no one could abuse power which could end up making it less fun for others. The rules are here to make the game fun. Unfortunately, when people break them, the game is no fun. As we just saw with the C3B incident.

I am also sorry you do not like me. :(.


EDIT: Also please note akots, that Matrix posted WELL AFTER I raised my point about the CoFA appointing the new ambassador. So had my simple point been giving the required consideration, Matrix could have easily appointed someone while he was not asleep.

And do not take this personally :).


EDIT 2: Oh and Magny my good boy, this forum is much more alive than it was without Provo and I. If you don't like the boring(yet important) legal stuff, simply skip it. Thats what I did in my younger days :D.
 
Actually, Matrix should have appointed the temporary ambassador before he left the forum. I have been waiting on him to do this and was rather surprized he did not. Apparently, he was occupied with something else and did not have enough time.

But this will come with time. Are you currently playing PBEMs? Or multiplayer games? Or Succession games? Or Game of the Month? This is very useful to develop your Civilization play skills and gain experience!

Well, what can I say, I am not blind. I think you are cool Akots, we disagree here and there and we agree somewhere. Magnusmarcus is a different story, hostile and sour without any exchanges of ideas, I think I will ignore him for the remainder of my participation here. I do not waste time on people depriving me of entertainment value.
