Files do not match host

I have upgrade to version 1.09...however when I join direct IP game its says your files does not match the host(we both have upgrade 1.09). However I can join and play..whats going on? Seems very laggy in MP also. Unpatched version runs perfectly,

I consistantly get this same message, anyone know what the deal is?

But i get the message using the regular Gamespy server, i don't direct IP anyone.
