I think more accurate to the top one is the original artist saying "yeah sure that's fine, it's a cool take on my work" and the corporation who owns the artist's copyright responding: "UNACCEPTABLE!!!! ONE MILLION YEARS COPYRIGHT STRIKE!"

Some artists would be ok with it, I suppose. Although I am willing to bet that it is (sadly) far more common to be petty about such things among gfx artists, than coders - then again, this may be my impression simply due to having more connections to gfx artists ^_^
