Ok, I am not used to needing patches and what not when a piece of software comes straight out of the box, nevertheless the patch solved all my (known) problems. Now I can finally give the game a go, cheers. :)

latest nVidia driver from leadtek website, the driver is listed in the dxdiag dump, actually the lastest driver on the website is the same one that came with the card.
