Right you are, as they don't seek the death penalty or life for police dogs. They do however still relate a police dog as a police officer and carry stricter punishments than if it were just a neighbors dog. Laws on this vary by state.
I could be wrong, but I don't think they send dogs in to "attempt" to dive on a armed criminal that is quite coherent of his surroundings and where the dog is. I don't doubt there have been events where police have sent in dogs like this. But you mainly see them send dogs in to grab a fleeing...
Looks to me like the police followed procedure quite well. You don't approve of this form of protocol, then move to a different country. But good luck finding a country that's "safer" for a tool/weapon wielding criminal to rear up like he's going to attack within striking range of an officer...
