Are the at-large governors absent?

I would like to request that the process defined in CoS Z.2 be used to determine if the at-large governors have abandoned their positions. We have had two turnchats and have had no slider instructions. The Vice President has repeatedly asked for the senate to meet and determine slider options, with no response.

Since the three books entry is not complete for the CoS, here is a link to the ratification poll.
 
Since our city was recently sacked, perhaps we should determine whether they were captured. Instead of assuming that they have abandoned their posts we should send out search parties and rescue them if necessary. :)
 
Your request that the Judicial Branch initiate the Absenteeism process has been duly noted. PMs have been sent out to the three Senators that state the following:

Dear Senator,

It has been determined, because of your lack of response to the Senate President's request for discussion on Slider Controls for the Demogame, that you have abandoned your office. Please post immediately in the appropriate thread located in the Citizen's Sub Forum your intent to rectify this situation, or lose your position.

Chief Justice Cyc

All Senators have 96 hours to respond. If not their position will be considered abandoned.

Umm, well Noldoden never told me he was leaving or something, ans so I thought he would take care of it. I am not getting enough time lately. My dad is here until the 15th so I am spending most time with him.

Now I thought I only had to post orders when they would have to change, we are not to change it, *yet*. But I will try more often to post the orders sinse I dont here about Noldoden.

Here is the legislation in question:

2. Should an Executive or Legislative leader fail to post instructions for 2 consecutive game play sessions, without posting in the official absence thread, any citizen may request that the office be declared abandoned by creating a thread in the Citizen forum.
a. The Chief Justice shall then send a PM to the office holder, notifying them of the request.
b. The Chief Justice shall then post in the request thread that the PM has been sent.
c. Should the office holder fail to reply by posting in the request thread within 96 hours of the PM, the office holder is removed and the office is considered vacant.


I would like to point out a couple things regarding these rules.

1) To the best of my knowledge this legislation was just passed a few days ago, in time for the last game play session. It has not even been in effect for two game play sessions so invoking it is premature.

2) It is doubtful that this legislation even applies to Senators for they are not empowered (as Senators) to post any instructions! The President of the Senate (the VP) is required to post the slider instructions and an instruction post was made for the last game play session.

I therefore ask that this premature thread be closed.
 
Hey donsig. Thanks for posting the appropriate legislation for this thread. I feel that this thread is justified for reasons dealing with the points you made in your request above.

1. This Legislation was ratified 01/05/04 around 2330 hours your time. This would have allowed the t/c on Wednesday and the one on Saturday both to occur. These are the two t/c's in question.

2. The Legislation specifically states Legislative leader in it. The point of Law does not state posting instructions in the TCI. That would be the responsibility of the Vice President, as I'm sure you're aware. The VP needs to post instructions there from the instructions posted by the Legislative Leaders (Governors/Senators) in the Senate thread.

As both of these points are covered, I would say that this thread is, in deed, timely and justified.

But the office of VP / President of the Senate was filled only hours prior to the Wednesday turn chat and it is not even clear exactly when that office was filled. Holding the Senate responsible for posting instructions they were not even legally entitled to post on Wednesday is asking too much I think.

I have asked for a Judicial Review on this matter. I do not see how you can apply this section of the CoS to Senators when they are not empowered to post game play instructions!

I have requested a Judicial Review on whether this law applies to Senators.

A hundred, thousand apologies for not fufilling my duties as a governor and senator, it shall not be a repeat occurance. I will see to that.
 
Noted, though I will have to post a link to the poll, as I'll be in school at the time of the tc.
 
All responsible parties having responded in the affirmative that they intend to continue in their positions, the request for determination of absence is closed. :D

Cyc, I don't think this statement oversteps the bounds of the judiciary since the law says what should happen if there is no response, but doesn't appear to say what should happen if there is a response. You're welcome to post a confirmation message if you feel it is needed.
 
Well, DaveShack, thank you. I would love to contribute, but at this point I'm thinking someone will throw a Judicial Review or Citizen's Complaint at me. :)
