Bug - Open Borders?

I'm playing the True Starting Locations map for Earth (very popular mod map) and I'm the Iroquois. So of course, I go after Washington when I get some units. I invade, start hammering away at them, and then Washington pops up a dialogue and asks me if I want open borders. Kinda silly, since I'm right on his doorstep, setting the white house on fire. When I say, "refuse", suddenly I'm popped outside his borders. What is up with this? Is this a bug? Does everyone know about this, or am I on my own?

Don't wanna troll but the strategy forum is the last place to report this. Probably a bug...or the AI is fed up with people using exploits and now using exploits against you
