Penalties

So I was playing Civ 3 and this thought just crossed my mind. We should have penalties if we execute recon missions over other nations territory. Think of the U2 shot down over the Soviet Union. I don't mean that the other nation should declare war on you instantly for something of that sort but they should be able to shoot down these aircraft or at the very least a chance at being noticed and therefor hurting relations with them. This of course would be negated by a right of passage agreement. I'm sure there are other actions in game that this could be applied to as well. For instance if you have to fly over a not so friendly adversary to bomb and enemy on the other side of their territory.

Thoughts, likes, dislikes?
 
I thought of that a couple times, but in the scheme of things, if a nation can get away with doing something, it usually will until someone comes along who can stop them.

Drawing on your example again, The US kept flying U2's over USSR territory because it was believed the aircraft flew too high to be shot down. Hello? This is an emerging superpower we're taunting! But it wasn't until they developed a missile capable of reaching a U2 that overflights stopped. When the SR-71 was developed, it could fly fast enough to outrun any missile. We probably did overflights again until the Soviets developed the Foxbat, which was a stripped down fighter whose sole purpose was to outrun and shoot down an SR-71. At some point, satellites got good enough that spyplanes became unnecessary, and sats overfly everyone. Yes, they can now be shot down, but we're all at peace right now, and treaties prevent that.

In the rare instance that you're not at war with someone you don't have OB with AND the enemy doesn't have sufficiently advanced fighters to intercept: absolutely, I agree with you 100%. I can't move land, sea, or missile units in there, I shouldn't be able to move air units either. But this situation hardly ever develops, at least in my games, so I'm not gonna lose sleep over it if they don't do it.
