I believe there should be found another theme to be played when Victory is achived, because the song is only some 25 years old, hence still copyrighted, and a protential hot potato ... rather find something original composed in the era and area

That's not how copyrights work. Even 1000-year old songs by unknown and dead composers are copyrighted, because copyrights also belong to the musicians who recorded the songs, not just the authors of music. Every single song used in this mod (and other mods for Civ3 and other games) is copyrighted. Pretty much everything on YouTube is copyrighted, even personal videos.

The laws are there to give the copyright owners means of protecting their interests, if they feel they are theatened. They don't make using someone elses work necessarily a legal problem. This particular song is performed by two guys from Qatar and it's available freely on YouTube, and Nintendo isn't exactly sending lawyers against them or hundreds of other people who do this.
