Cannot build Forbidden Palace in captured city

I captured a city from a civ before they got to 8 cities. All of the cities I captured from this other civ would not allow me to build Forbidden Palace and the reason in red was that the Civ needed 8 cities. I had 11 cities after all of these I had aquired.

Couple of questions:
1) Can you usually build Forbidden Palace in captured citys?
2) How does it count how many citys you have? How many settlers you have used to found them? or does captured cities count as well.

I have a save game of this problem for version 1.61 if anyone is interested.

It should just be counting how many cities you have, it shouldn't matter whether they were built or captured. Similarly it can be built in captured cities. Does the city have a courthouse? The red reasons do occasionally screw up. Posting a save would certainly help.

Duh. There was no courthouse in that city. I built a courthouse in the savedgame and then I could build the Forbidden Palace. The red notes were wrong, but I should have caught that I was missing the courthouse.
