dataIO error, vista and pbem

so i buy a new and better laptop, with vista. installed civ3, patch with 1.29f, load conquest and patch with 1.22 full. i have at this point no mods to the game. i try to load up files from a pbem and i get these errors

dataIO operation system file: date
dataIO operation system file: plgi
dataIO operation system file: cnsl

then game dumps out.
now these same saves work on my older laptop with XP. i tried to load a save straight from the forums as posted but same problem. the game works fine with other saves from within the game.

so is the problem with vista the computer or what?
