I share a continent with Tomyris and Gandhi. Gandhi has built some nice cities for me and its time to take ownership. I can get Tomyris to declare joint war with me. I can see that I can propose joint war on either side of the trade. What is the difference between me proposing the deal with it on my side or Tomyris' side?

If I offer joint war on either side of the trade she will also toss in 14 gold and 3 GPT - that amount doesn't change

I would consider who I would want to face by myself second and will I have better troops by the second Great War that would help more.

If you are wiping people out it matters little but if you are asking what I would do with my style I would joint war Gandhi without a doubt. I hate the whining little warmonger and getting +6 with Tomyris is quite likely to run into friendship.
It is early enough to wipe the two faced Indian off the map (this game shows no respect for Gandhi) and I need the size initially. I would then make sure I formal warred Tomyris took most of her cities and then depending on the length of the war I would give x cities back. At the end of the war I would have Tomyrises best cities, she will be in tatters and possibly revolting but more importantly then be a good friend and trading partner and I would certainly expect her to be my ally.

+3 envoy
+2 trade route
+2 good trade relations
+6 ish for friends In the past
+2 ish for joint war

Plenty enough without bribes or open borders for DOF. If you expected the war with Gandhi to last less than 30 turns then do not DOF Tomyris and you can make up the extra ground other ways. It will be worth being allies in the future.

I would then be strong enough to take on the world With any VC but avoided a lot of crappy low production no luxury cities that would just take more time to manage and force me to build more entertainment districts. She would be a great source of extra gold, future joint wars and for me the game is richer when I am not so lonely

I really do not like it when Gandhi says I cannot explain why I am declaring war on you.

Not sure that it's broken, but your (left) side would still be what you are offering the AI (right side). I do joint wars early but only with an AI that has something to offer (as you previously mentioned Tomyris has done).

If you put the joint war on the right side, and the AI is still offering you compensation, then they are probably going to war with the AI very soon and you'll miss out on compensation to join in.

So I ended up taking the money, declaring joint war, and taking every city that Gandhi had. This didn't hurt my standing with Tomyris one bit. I took a bit to consolidate and grow my cities. By the time Tomyris got tired of me and declared war it was AT units vs Horsemen.
