They should allow the capture of pows--captured units that retain possible combat value if they escape. These units would have to be held in a city with a military prison and perhaps could add victory points in certain scenarios. This would be a unit I wouldnt have in all games however.
 
Too much complication. Thats like three things you'd have to worry about then. To some extent this is getting too detailed. Now every turn we'd have to worry about a prison break.
 
maybe something like

$-guards
$$-more guards
$$$$$-the most guards
or the more guards you hire the less chance of a jail break. But in your army they shouldn't really have a choice( the guards) what they want to do, like in real life. They do what you tell themj to do.
