Term 6 Judiciary

I have to disagree with my esteemed colleague, CJ mhcarver. In reviewing the Constitution, I have found that Article E may be interpreted in more ways than one.

Taken from Article E

"The President is also responsible for all tasks not assigned to another leader."

In a situation such as the one Alphawolf has brought upon us, where there is no Leader in the Foreign Affairs Office, the responsibility of bringing about a Declaration of War (to include the polling and discussions) is not assigned. It might be argued that this responsibility, or task, is assigned to the Foreign Affairs Office, but as you can read above, Article E states that if a Leader is not assigned this task, then the President is responsible. It says nothing about an Office.

We all know that Alphawolf is gone (although he may still be with us in the likes of players like GeorgeOP) and it is now official. In the opinion of the Public Defender, if the need arises (such as a Declaration is needed before a new Minister can be found), then the President may post the poll.

EDIT: In reading this opinion again, I find that my overall thought seems incomplete. What I meant to say was that in addition to a Deputy, who may step up as a Leader and post the poll, the President may, in times when there is no Deputy (thus no Leader) post the poll. In contrast to CJ mhcarver, I believe that a Deputy is not the only person able to post the poll, that in certain circumstances, the President may also./EDIT

I understand what Cyc is saying, but the key word is "assigned". Even if the office is vacant is the power to post war declaration polls still assigned to that office?

I am not posting an official opinion yet, because I want to see what others think about this.

I understand your hesitation, JA Black_Hole. If it would help, let's look at the CoL for Declaration of War. It states -

"To declare a war, the Minister of Foreign Affairs will create a normal poll..." , it doesn't say "The Office of Foreign Affairs", which it could have.

Also take another look at the Constitution. Revisiting Article E, we see -

"The Minister of Foreign Affairs is responsible for all matters involving treaties with foreign nations...". Again, it doesn't state the Office of Foriegn Affairs, just the Minister.

So if there is no Minister and no Deputy to back that missing Minister up, then there is no one to assign said task to...

Article E states that the president is assigned all powers not assigned to another elected official, so the President receives the power to post polls for war declarations. So, I agree with Cyc, in absence of the FA minister and deputy, the President has the power to post polls asking for war declarations.
 
Well, JA Black_Hole, it appears as if our beloved Chief Justice has abandoned us for the [civ4] DG Judiciary. The Judicial Procedures are a little vague on this process. Shall we just vote his position vacant so you can fulfill his duty of recording JR1? Or do we need something more official? I say let's vote him out, you take over his duties and responsibilities, and I'll back you up.

CJ mhcarver hasn't posted in the [civ3] DG since January 9th, but has posted elsewhere in Civfanatics. I believe this gives us cause to remove him. If we can get JR1 for this Term recorded, that should pretty much wrap it up. Your thoughts?

mhcarver cursed, he knew he shouldn't have left his keys outside of the secret wine cellar he had installed underneath the old PD office, thankfully the PD hadn't found those pictures of him and the frat girls, or if he had he hadn't raised the issue of whehter or not that we legal, or if it was the horses fault in the other pictures. But anyways after he had been locked underneat that cellar for several days he was eventually found by the cleaning staff, somewhat intoxcated, I'm not as think as you drunk I am he bellowed out loud, after coming to , he realized that those photos hadn't been hidden and he had forgotten to update the log
