Where is this patch 1.09? If it's not on the official website for Civ4 or the 2k site, is it even legit? Should we actually be using it? Who is it endorsed by?

It is produced by Firaxis. 
It is available in game. Go to the Main Menu, then Advanced, and select "Check for Updates". It will be available for download from 2K's website soon.
