As far as I remember it doesn't matter if you have the tech, but you must be able to build the unit (as in have it checked in the editor under your civ)? That's why you can't capture the Hwacha in the original game, but Korea can capture the Cannon (because they got both the units available).
I usually don't add any flavor artillery units for the same reason. I like being able to capture the AI's artillery, but that doesn't work well if you have civ-specific units.
