Bug or something I've missed?

Well, there are a few modmods that increase the use of CoE, albeit only in the aspect of units. Try out Tarqueline's modmod that adds in 2 Calabim UUs, the Bloodseeker (a non-CoE assassin unit) and the Angel of the Eclipse (a CoE Shadow UU). So, it all depends on your gameplay style imho, whether you like CoE or not. I'm generally a warmonger, so I generally choose OO for the Drowns and Stygian Guards. But sometimes I mix it up with some stealth and CoE. It's all up to you, man.
 
it's the wonder Nox Noctis that gives invisibility, so you don't need a state religion.
Having CoE as state religion allows you to make use of the Undercouncil resolutions, which are very good.
 
All you need is Undercouncil as a civic.

I may have encountered something similar. However, bear in mind I was playing the ORBI modmod and that may have something to do with it. I was using a captured Griffin to explore and had managed to get it promoted to have a move of 4. I sent it on a path that crosses a Svaltafar city (not at war), which was garrisoned with an Adept and several Archers. At the start of my turn, I was surprised to find that the Griffin had killed the Adept and was now parked in the city. The Svaltafar did not react adversely and when the Griffin departed it was not attacked again.

Yeah, the Svalfatar can't whine if you kill their HN units. After all, they appear barb to you, man. BTW, did you actually capture the city?

Sadly, no. They had four or five Archers defending and all I had was my Griffin.
