I'm not completely sure, but the problem might be related to your DirectX.

Try upgrading it to a newer version.

What are your system's specs? Video card? Are your graphic drivers reasonably recent?

That would have been a possibility, but it can also indicate that the directx may be having difficulty with the video card. Updating the video card drivers may alternatively help.

its a laptop with built in graphics intel (R) 965 Express Chipset family

i did all windows vista updates and downloaded newest direct x drivers

same error

suggestions?

Go to Acer's website and search for drivers for your particular laptop. See if any of them pertain to video. If not you Intel will probobly have the last drivers for thar chipset. Its been awhile since I've visited Intel, though, you might have to know your particular MB.

I have the same VC and I had the same problem, but luckily I came to a fix. Try to change the graphic details to medium or low and the game will start, at least this works for me

It has now been 2 years and I am still having this problem (I just bought the game last month).
In the intervening 2 years, I am sure someone has found some kind of fix to this problem.
This problem plagued a great many players of a great many different games, back when
Vista first came out. I am now using Windows 7 but none of the backward compatibility
modes fix the problem. I have been googling
APPCRASH d3d9.dll c0000005
for almost a week now and have seen literally thousands of complaints about this error
from hundreds of games, BUT NO SOLUTIONS! The complaints are mostly old, though,
so I have to think a solution was eventually found somewhere... meanwhile, I still
can't play the game.
I applied the 1.01f patch but no change.
My video is onboard (not a separate card) but it is not under spec;
I bought Colonization as part of Civilization IV Complete and all 3 of the Civilization IV
variants play fine.
This one sort of looks like it would, too, except for the AppCrash due to graphics at the
beginning, which seems to involve dismissing the greeting panel that profiles your leader.
