copyright and youtube

Yesterday I was walking along the Akerselva, the river bisecting Oslo, and there were some open air shows from various artists and amateurs (it's a tradition for the equinox).

It's all open, free, and everybody can take photos and videos.

I did take videos and uploaded on Youtube.
A few have been marked for copyright infringement.

For example this:

Youtube notified me that "Video blocked in some countries."
"Some countries" means Germany and that's due to the music played in the background.

I can either "Acknowledge" or "Dispute".
I can't really acknowledge because I don't think I'm infringing any copyright, it should be fair use.
However if I dispute I assume on myself the legal responsibility of fighting for the copyright: "If you believe that your use meets the legal requirements for exemption from copyright under appropriate law, you can dispute this claim. If you are unsure, you should seek legal counsel before submitting a dispute"


I get really pissed that one is automatically guilty until proven innocent: the alleged copyright owner doesn't have to prove I'm really infringing.
I have to prove my innocence. :(



What do you think?

Can I claim this is fair use?
