Joining private multiplayer games

I'm surprised I can't find any threads about this subject, so I suspect my friends and I are doing something very simple wrong!

Short version of question: Can a human player always be invited to join a private game when there's an AI civ?

Longer explanation: Every once and a while when my friends and I are playing, someone gets disconnected for whatever reason. I'm always the host, and I invite them to join the in-progress game. However, two of them have said on separate occasions that they couldn't join because Civ 5 says the game is full.

I assumed as a result that it wasn't possible to join in-progress private games even if there is an AI slot (even if you're just taking over for yourself a turn or two later!), but that doesn't make sense why there would be an option to invite people to join. So, a friend and I tested it by ourselves, and he was always able to join my private games. If it was four AIs and me, he could join; if it was just an AI and me, he could join; if he started the game with me and got "disconnected", he could rejoin a couple turns later when I invited him; and so on.

Why do invitations to private, in-progress games appear to work sometimes but at other times refuse to let people join?

Hopefully someone can save us from having to save, quit, and relaunch the lobby over such a small issue. : ) Thanks!

Edit: I know the fall patch just came out today. What I described was pre-patch, but I didn't see anything in the release notes that related to my question.
