Because they can't possibly build it, IIRC. The Apollo Program is disabled, isn't it? I know if you don't allow diplomatic victory, then the UN can't be built.

No you can still build the apollo program wonder even though the space race victory condition is turned off, and they don't build the apollo program if that condition is off.

How do you know they didn't build it? It's a small wonder and you don't get notification when they build small wonders. If you are relying on spies to tell you this, then the espionage part may be disabled, but they may have built it. At least for the culture.
