Multiple units from different civs on same square

I'm pretty sure this is a bug if not its a HUGE flaw in gameplay.

I'm playing a warlord game right now and found the perfect choke pointfor the continent (right on a hill). Although I wasn't at war with the other two civ I blocked this off so they couldn't get by. To my surprise and disgust somehow I noticed a warrior who was on th eother side of my blocking unit, then when I clicked on my unit a second unit was listed for that tile from the other civ (another warrior). Turns out units are just walking right over top of me. If I try to walk over their units it declares war. What the heck is up here? BTW we don't even have an openborder agreement as it is very early in the game.
 
Units can share the same square if not at war. The first time you try to occupy the same square as a foreign unit, you will get prompted if you want to attack - answer "No" and you will move on top of the foreign unit without attacking.

They can only cross your border with an open border agreement, but you can still share a square in the open (outside borders).
 
Thnak you very much, makes sense now. Just wish they hadn't implemented this as it just takes out more strategy in early game :(.
