Is it by design or simply a bug? see ex. below: I'm at war with Japan and have open boarders with Rom. The Chu-Ko-Nu cannot withdraw on the road as far as one could expect.

You can't use a road if it is on enemy territory (you'll move like if there is no road). In conclusion: it's not a bug.
