That is out of date with BNW which introduced the "AI Handicap level"
AI now gets a new science handicap that wasn't there at all. (Presumably to offset the new per city handicap, but it's a much bigger discount than the penalty would ever be)
The base happiness percentage is around warlord; it's still multiples at levels above Prince and so is still effectively below Settler at Immortal+
AI continues to get a cultural policy discount; (presumably to offset the cultural per city penalties; but again much bigger discount that the penalty would ever be)
So to the OP, bottom line is the AI isn't immune to the penalties, however it gets such a large handicap in both that overall it's getting bonuses.
