Public Investigation #7

Accused: Rain
Crime: Refusal to carry out duties of the at-large cabinet member position.

The accused has refused to post a citizen poll for the vote in a cabinet poll for the affirmation of Civanator as governor of Ameri until such a time as we can elect another governor. As this is the primary duty of that office, this is a severe crime.

Please reserve the first post after this for Rain's self defense.

The evidence is here .

The relevant consitutional section is:

Article 4: At-large council members are responsible for representing the will of the people in Cabinet Votes. They will poll for popular opinion on prospective Cabinet issues and MUST vote according to those poll results.

I support Rain. We're currently at a crisis point now, and I think we should let the flames burn out first before continuing.

Now that Chieftess is out with it... ;)

I, too, support Rain one hundred percent. I'd support him even more if that were mathematically possible...

I support rain also, If need be and I think the cause is right we might have a public investigation #8 soon. ;)

This will also be a tough one. I would like to say i support Rain here, but i am sorry... even if maybe understanding her... i must say she is guilty for me.
Eyrei is right.
Article is clear, no way for her to excuse. She is not a cabinet position for herself like donsig is not playing the game for himself.
She could, for example, have put up a citizen poll for boycotting all cabinet-votes. Just as an idea. Or put the option to "boycott poll" in every citizen proxy-poll for cabinet-polls.
The way she did is not right.

What we have to see is the result of the poll when all voted. I expect the 2nd councilman to post the citizen poll now, and then this here will have no effect on the result.

Im really unhappy with the situation at the moment and hope the PIs will be over soon.

Again:
I can understand Rain, but she also has to see her duties.

To the point which punishment it would have to be:
If Rain will change her mind imediately(!!!), a "final warning" would be sufficient.
If she does not change her mind and continues in the duty of her job, im sorry to say that impeachment would be the only way.

The way she did is not right.

Sometimes you must do something against the law to get your opinion through.

Like end a turn chat?

Seems you are using a double standard.

eyrei: this point goes to you.
thats why i really would apreciate if she shows good will and posts the poll now with an "boycot" option.
it would show that only her way was wrong.
the thread here is definitely not for campaigning, though. if she is guilty, then we must find her guilty. otherwise, the mods will and then she looses office and we the investigation-possibility.

I wholefully support Rain in this, her opinions are just as valid as if she were a citizen. By allowing this investigation you are saying that the cabinet must "fall in line" with the presidents wishes, whether or not you like them. This is a profoundly stupid idea to put forward.

EDIT: Oh wait I just got a fabulous idea, lets change the constitution's wording so this doesn't happen again

She is not required to fall in line with the president's wishes but with those of the citizens. This is clearly stated in the constitution.

I said that meaning that you can still get punished for the actions. I just support rain in her actions, but I don't support your actions of ending the turn chat.

I didn't end the turn chat, though it was done partially because of my suggestion. Regardless, this is not the place to discuss that issue.

I agree with dis. Should Rain post the citizens poll, I will withdraw my accusation.

As Bill in PDX suggested in the other investigation thread, my secondary intent in posting this thread was to unveil the hypocrisy surrounding the investigation of our president, after my desire to keep the government functioning.

yes, rain, post the poll, it is for the best. Hopefully you will garnish enough support to ensure your plans are upheld.

Eyrei: my desire to keep the government functioning.

That may work, but at what cost? The constitution? The citizens rights? You follow the constitution in this instance, yet 2 threads over, you seem to regard it as a "suggestion sheet"

Eyrei: hypocrisy

An excellent word might I add.

Section B: Government
Article 1: Six council members each head a department. Departments are Domestic, Foreign, Military, Science, Culture and Trade. Two council members are "at-large", are responsible only to the citizens and have NO DIRECT GOVERNMENTAL RESPONSIBILITIES.

My emphasis of course, and what does that mean no direct governmental responsibilities. it is of course vital to this discussion.

Yes it is.... Thanks curufinwe

I believe it does, as such I posted that I think rain should hold a citizen poll.

I believe I made my point clear that Donsig violated the constitution. I don't see how that is regarding it as a suggestion sheet.

Rain has posted the proper poll. Please vote. The charges made by myself can be considered dropped.

Duke, or Duck, would you please close this thread?

as it is no longer an issue, I would like to extend my hand to Eyrei in the hopes of ending any hostile feelings we may share between one another. I'm going to stay out of these arguements as I really don't care anymore. I just want to play the game with a democracy and let everyone be heard. Unfortunately, as I do not know how to implement this, I am withdrawing from the game permanently to avoid any further confrontation.

I will certainly accept your hand, Immortal (though not in any matrimonial sort of way:crazyeye: ), and urge you not to leave the game. I believe you are sincere in your desire to have a democracy, and therefore I am quite sure your input would be valuable to that end.
