[Col] Sneak attacks

In my last game, playing as England, the French deployed several units near my colony. We were not at war but they attacked my colony (losing pathetically ). How comes the foreign nations can attack you without starting a war, but when you want to strike back you have to break the agreements and start the war

Were you still at peace after the attacks? If not then it seems quite fine. You can attack them too anytime you like.

Yes, I was still at peace, because when I tried to attack them on my next turn, I was asked to break the peace treaty.

Sounds like a bug then.

You can attack, and the computer can attack you, without declaring war, when there is a privateer in the colony. This is also a good way to manipulate the computer into losing units it stations outside your colonies, by first putting a good defence in the placing your privateer in it.
