Like I stated in the post above yours: I have a pretty good military in my current game, plus how could an AI that hasn't even met me yet send troops over with a DOW - especially when they're half a world away from any of my cities? If your theory were true, Congo would've had to decide to declare on me/send troops *well before* we had even met.
But even Monty hadn't known me for that long when he declared. And when we met, my military was already as strong as it was on the turn of the DOW. Plus (like I said above), during the war, none of those guys even moved towards my lands. They declared, I waited, and they were willing to make peace during the first term peace negotiations became an option.
It's capable of declaring war while the troops are underway. It likely collected a bunch, send them over, decalred war, then decided against it and send its troops back home.
'A pretty good military' is likely true from a player perspective, but if you're on immortal or deity, an army of about 5 units at that time will seem like a cakewalk to them. Which I'm guessing is about the max you could be having at that point. I've done a lot of battle royale testing, and the 't20' declaration usually happens towards city states there, it's frequent, but doesn't happen every time. It almost never goes for players then, because all the players also have large troops. Except for the one I started with, as it's stuck on prince, which indeed does also get attacked frequently at the t20 point.
