And most retailers either a) won't take returns on opened packages, b) won't take non-defective returns ("i didn't like it" "too bad"), or both.

EBGames' policy is :

It's unopened? (still factory sealed) I can return it no problem, if it's within 14 days of purchase.

It's opened? then I can only return it defective, in which case I give you another copy of the same game

Not legally, they don't. Did you read your EULA? I did. Depending on what coutry you live in it is a legal contract (USA, Canada, and the EU at least, maybe more jurisdictions)

When you clicked "I Agree" you said that you will take the software "AS IS" and that they were under no other legal obligations and if you want to sue them it has to be in a friendly court and can't be for more than you paid for it.

Okay, that's me being anal, but they don't have a legal obligation.

And what happens if you don't agree with that EULA? Can you say "I purchased the game/program, I read the EULA or the thingy you have to read before clicking I agree and there is something that I don't agree, can you give me my money back, please'?

It is not that I wanted to be picky, I am just curious.

BTW. you being anal means being analytical, Isn't it?

 Lets just say he's analytical to the point where he is annoying(hint: its a body part (don't google it))

Thats an interesting question about the EULA. The EULA usually says about taking it back doesn't it?

Yes, actually there is a clause about that. You had 15 days to get an RMA from Atari and they would refund your money.

Well, I meant anal, but...

I'm sure you're right about this.
Though you can't deny it was a cheating to sell us an unoperative product.
And it doesn't matter how many other companies done the same cause i bought C3C.

But be sure when most of the players will feel civ4 is really well-coded now and the main aspects of the game are working (which is not the case with C3C) i shall go out to buy it cause i'm not less excited than the others just cautious.

Nice poll. IMO the people who voted for 0 clearly have no experience with writing any software.

I do think the game is rushed under pressure from Take2, the publisher of the game. They made a quarterly loss of a whopping 28 million dollars for the quarter ending July 31st this year:

http://videogames.aol.com/game_news.adp?gameID=8600&articleID=322926

And the fiscal year for Take2 ends at 31 October. So looking at their shareholders it makes a lot of sense to try brushing up the figures a bit.

Ironically, the main reason for this heavy loss, according to the linked article, was the 'Hot Coffee' disaster from the GTA game, also published by Take2, and which 'feature' was discovered incidentally by a Dutch guy. Maybe that's why The Netherlands are not in Civ 4, the Firaxis developers won't be pleased that because of that they have to work around the clock to finish the game

But in the end I think (I hope!) this will not impact the quality of Civ 4 too much, because it's released only 2 weeks or so earlier than originally planned. I do hope the Firaxis developers will get a nice holiday to recover from what must be 80-hour working weeks around this time.

The point of this poll was
(a) to highlight the fact that every game these days is not thought through properly and when combined with the twits in marketing and management putting pressure on games creaters, the result is sloppy games being released. Another poll I will start after Civ4 is released is: How many updates will be needed before the game is stable?

(b) guage civ-fanatics memory as to the awful experience of Civ3 and wonder how many of them will actually pause before buying this time? I'll be watching the forums for screaming frustrations as this card dont work or that sound card causes crash or something else messes up at such and such point. Is history about to repeat itself?

It looks like you were exactly right.

Now where is that new poll you promised? :)

You should have added another option to the poll btw based on another thread's title "entire game is a bug"

entire program is a bug (Windows ME coding)

I want to emphasize I think Civ 4 will be better than Civ 3 once the bugs are fixed in about 6 months.
