closed/open borders diplomatic bug?

Has anyone else gotten diplomatic penalties for having closed borders when you really have them open? Is this a bug? This is with aggressive AI, so maybe that has something to do with it?

there is no diplomatic penalty from having closed borders, never.
There is a diplomatic penalty from having CLOSE borders = cultural competition for tiles.
