And does the "you backstabbed someone" diplomacy penalty factor into the ai's "thought" process? If not it probably should.

Yes, it does. It's just not a limiting factor.
Yes, I added it more for the AI than the human. Basically, the AI will know that you won't honor any agreements and basically try to have nothing to do with you.

I actually meant does the AI consider what that negative relation will do to its own relationships with other AIs if it wardecs a player it is friendly with.

Yes. Even with Ruthless AI, it's relatively uncommon for friendly declarations of war.
