A Lord's treaty is Law for his vassals. All the members of the HRE serve with and under the Frankish Empire (IIRC). Therefore, war with any member would be war with the entire thing, which would break your treaty since the Frankish Empire is part of the entire thing.

Now the Emperor, the same person, and the same throne, has all of catholic Christiandom under it. Therefore your treaty would obviously through his person reach all of catholic christiandom who are under him, the same way that it reached Aquitaine who was under him.

No. A state of war is when hostile acts are occurring on a regular basis, not the 'absence of peace'. Otherwise, you may say that Rome was at war with every single barbarian tribe since the Gauls - there was always an 'absence of peace'.

On the contrary. I would say the reconquest of Aquitaine, subjugation of Visigothic christians south of the Pyrenees, and constant border skirmishes disprove this fact.
Then again, Aquitainians look to roman law.

The reconquest was 110 years ago. The Visigothic Christians were never part of Aquitaine or Frankland, and at no point swore fealty to the Franks, and no border skirmishes have come to anyone's awareness. None of these constitute a war.
