I check government before attempting just to make certain they haven't gone to democracy. My perception is I have better success when the opponent is in anarchy, but that is merely perception and I haven't kept notes to check figures.

Acording to my testing the chance of planting a spy is 50% for regular and 60% for veterans. I get the same results when the AI is in communism, despotism or anarchy.

I haven't tested this, so I can't say. I haven't found the time to increase my test scope. I DID notice that spies steal btter than diplomats. Grille has a link to the results in his post for those interested.
 
Oh, okay, it's just the espionage missions that you can undergo before you can get spies. Got it. ;)

Also are the chances of catching an enemy spy higher when the I.A. is in your capital?

I don't think it really matters. I haven't heard one way or the other, tho. I'm sure we would have found that out by now if it did make a difference.

Maybe you're trying to steal with the diplomat while at war with that civ (which is only possible with a spy)?
